Terms of Service

1. Acceptance of Terms

By accessing or using the Novatria platform and services, you agree to be bound by these Terms of Service. If you are using Novatria on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Service

Novatria provides a unified control plane for data governance, security operations, observability, and compliance evidence. The platform is delivered as a cloud-hosted SaaS product with optional on-premise agent components.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to misuse the platform, including but not limited to: attempting to gain unauthorized access, transmitting malicious code, interfering with service availability, or using the platform for any purpose that violates applicable law.

5. Data Ownership

You retain all rights to your data. Novatria processes your data solely to provide the contracted services. We do not use customer data to train machine learning models or for any purpose beyond service delivery without explicit consent.

6. Service Level

Novatria commits to 99.9% uptime for production environments as measured on a monthly basis, excluding scheduled maintenance windows communicated at least 48 hours in advance.

7. Liability

To the maximum extent permitted by law, Novatria's total liability shall not exceed the amounts paid by you in the twelve months preceding the claim. Neither party shall be liable for indirect, incidental, or consequential damages.

8. Termination

Either party may terminate the agreement with 30 days' written notice. Upon termination, you will have 30 days to export your data before it is permanently deleted from our systems.

9. Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
